On August 11, 2015, Andrew J. McGuinness filed a class action against Trott Law PC (also known as Trott & Trott) and its former CEO, David Trott, under the federal Fair Debt Collection Practice Act and parallel Michigan debt collection practices laws. The lawsuit, filed on behalf of named representatives Brian Martin and Yahmi Nundley, alleges that the defendants violated these consumer protection statutes in several ways: (i) by purporting to send letters from lawyers that were actually not sent by lawyers; (ii) by failing to state the amount of the debt, inclusive of attorneys’ fees; and (iii) by “overshadowing” homeowners’ rights under federal law to challenge the debt allegedly owed for 30 days without fear of adverse collection activity.
This class action seeks compensation for a class of Michigan residents who received foreclosure notifications from Trott & Trott over the past six years. Hundreds of thousands of Michigan homeowners and former homeowners may be affected. The lawsuit does not seek to preclude or set aside any foreclosures, but instead seeks statutory damages on behalf of several proposed classes.
